Summary:
For years, law enforcement officers in some agencies have
been able to ‘force blood’ from an impaired driver suspect
without a warrant. The US Supreme Court heard the case of
Missouri versus McNeely and decided that the simple fact that
blood alcohol content (or drug content) was being naturally
reduced over time as a result of bodily function WAS NOT
enough to justify an exigency that would allow officers to obtain
the blood without a warrant.
In the case of Missouri versus McNeely, the driver (Tyler
McNeely) was arrested for driving under the influence and
taken to a hospital where a blood sample was obtained without
a warrant (not required at this point). McNeely argued that the
police obtained his blood sample without a warrant and without
his consent. In trial, McNeely moved to suppress the blood
evidence on an argument that the sample was obtained without
his consent and without a warrant. The trial court found in favor
of McNeely, the State Supreme Court affirmed the ruling, and
the case eventually elevated to the US Supreme Court.
SCOTUS considered “exigency†argument – the underlying
justification for obtaining blood without a warrant to this point.
SCOTUS found that simple metabolism of alcohol was – by
itself – not sufficient to allow taking of one’s blood sample
without a warrant.
This decision resulted in a significant and notable change how
police obtain a blood sample from a subject who was not
expressly given his or her consent. Post-McNeely, when a
driver refuses to voluntarily provide a chemical sample, law
enforcement officers must pursue a warrant to obtain the
sample. Failure to do so may result in any such evidence being
suppressed in court. This requirement does not affect any
administrative sanctions (such as mandatory license
suspension) for a driver who refuses to voluntarily provide a
sample.
